The applicable Terms are those available online at the time the service is used. Memorable Day reserves the right to amend these Terms at any time. In the event of a material change, Memorable Day may inform Users by any appropriate means.

Article 3 – Description of the Services
Memorable enables a private individual Organizer to create a Money Pot intended to receive Donations without consideration. A Money Pot created on Memorable is immediately accessible via its direct link. There is no prior publication status: once created, the Money Pot may be viewed by anyone who has the link.
Money Pots are not intended to be indexed by search engines, are not publicly listed by Memorable, and are not accessible through an internal search engine. However, anyone with the direct link may view the Money Pot without an account and contribute to it without an account.
Memorable does not offer gift lists, gift reservations, or any consideration in exchange for a Donation. Donations made through Memorable are donations between private individuals, without consideration.
Payments are operated by Stripe, in particular through Stripe Checkout and Stripe Connect. Funds are collected by Stripe on behalf of the Organizer, on a Stripe Connect account linked to the Organizer. Memorable Day never directly holds the funds of Money Pots.
Article 4 – Conditions Applicable to Users
4.1 Conditions applicable to the Organizer
To create a Money Pot, the Organizer must:
- act as a private individual;
- be a natural person of legal age and legally capable;
- create the Money Pot on their own behalf;
- be the beneficiary of the funds collected;
- have a bank account in their own name allowing withdrawals to be received;
- accept these Terms and the Data Protection Policy;
- provide accurate, truthful, and up-to-date information.
The Organizer may not create a Money Pot in order to subsequently transfer ownership of the Money Pot to a third party or to have the funds paid directly to a separate beneficiary. For the time being, the Organizer is necessarily the beneficiary and withdrawals are made to a bank account in their own name.
The Organizer may edit their Money Pot after creation, including its title, description, image, or settings. The Organizer remains solely responsible for the accuracy, truthfulness, and lawfulness of the information published.
4.2 Organizer verification
Before making a withdrawal, the Organizer must complete identity verification through Stripe and provide the requested information, including in particular:
- full identity;
- date of birth;
- address;
- identity document;
- bank details / IBAN.
Identity verification may be requested, completed, or renewed at any time, in particular at the request of Stripe or Memorable Day, or in the event of suspected fraud, a dispute, or a regulatory obligation.
If Stripe refuses or does not validate identity verification, no withdrawal may be made until the situation has been regularized. The Organizer may contact Memorable at [email protected] for assistance with the process, without Memorable Day being able to guarantee validation by Stripe.
The Organizer may add several bank details / IBANs to their Stripe account. Bank details already added may not necessarily be modified directly; where applicable, the Organizer may add other bank details. Withdrawals may only be made to a bank account in the name of the verified Organizer.
4.3 Conditions applicable to the Participant
To contribute to a Money Pot, the Participant must be a natural person of legal age and legally capable, or have the authorization of their legal representative.
The Participant may contribute without creating an account. They must provide the information requested on the participation page, including in particular:
- first name;
- last name;
- email address;
- Donation amount;
- optional message;
- optional photo;
- visibility settings for certain information.
The Participant guarantees that the information provided is accurate, truthful, and lawful. The Participant undertakes not to publish or transmit any unlawful, insulting, defamatory, discriminatory, violent, pornographic, fraudulent content, or content infringing the rights of a third party.
Article 5 – Creation of and Access to a Money Pot
A Money Pot is created by the Organizer and becomes immediately accessible via its direct link. The Organizer is responsible for sharing this link.
Memorable does not protect Money Pots with a password, unless a future functionality is expressly offered. Access is based on possession of the direct link. Accordingly, anyone to whom the link is sent may view the Money Pot, the Money Pot information, and the participations made visible according to the selected settings.
The Organizer acknowledges that the absence of indexing or public listing does not constitute a guarantee of absolute confidentiality. It is the Organizer’s responsibility to share the link only with the persons of their choice.
Article 6 – Prohibited Money Pots and Prohibited Content
Money Pots must have the sole purpose of collecting Donations without consideration between private individuals. The following Money Pots, uses, or content are prohibited:
- those contrary to the law, public order, or accepted standards of morality;
- fraudulent, misleading, false, or likely to mislead Participants;
- involving consideration, a sale, a pre-sale, a lottery, a prize draw, or a commercial activity;
- created on behalf of a company, association, or organization, unless expressly authorized by Memorable Day and compliant with the applicable status;
- linked to money laundering, terrorist financing, fraud, identity theft, or any unlawful financial activity;
- infringing human dignity, inciting hatred, violence, racism, sexism, homophobia, xenophobia, or any form of discrimination;
- linked to weapons, ammunition, explosives, or dangerous products;
- linked to illegal substances, drugs, narcotics, or regulated products sold or financed unlawfully;
- promoting tobacco, alcohol, or products prohibited to minors under conditions that do not comply with applicable regulations;
- linked to pornography, prostitution, sexual exploitation, or any content harmful to minors;
- linked to gambling, betting, casinos, lotteries, or similar unauthorized activities;
- infringing intellectual property rights, image rights, privacy, or the rights of a third party;
- intended to finance a political, electoral, religious, or activist activity under conditions that do not comply with applicable regulations or that may create a compliance risk for Memorable Day;
- presenting an emergency, illness, accident, death, or any sensitive situation in a false, exaggerated, or unverifiable manner;
- more generally, likely to harm the image, regulatory obligations, or legitimate interests of Memorable Day, Stripe, or Users.
Memorable Day reserves the right to request from the Organizer any supporting documentation relating to the purpose of the Money Pot, the intended use of funds, their identity, their situation, or any element necessary for compliance of the service.
In the event of suspected fraud, misuse, unlawful content, breach of these Terms, a request from Stripe, or a legal obligation, Memorable Day may suspend the Money Pot, block participations, block withdrawals, request supporting documentation, remove content, close the Money Pot, or refund all or part of the participations in order to empty the Money Pot.
Article 7 – Participation, Payment, and Visibility of Information
7.1 Payment
The Participant freely chooses the amount of their Donation. Payments are made in euros, by bank card, Apple Pay, Google Pay, Bancontact, or any other payment method offered on the Site.
Cards issued outside the European Economic Area are accepted. No mandatory platform fee or Stripe fee is charged to the Participant at the time of their participation. A Voluntary Contribution is offered to them, which they are free to add or not, under the conditions set out in Article 9.
Payment is processed by Stripe. Memorable Day does not directly collect bank card data and never directly holds the funds of the Money Pot.
7.2 Information provided to the Organizer
For each participation, the Organizer may receive a notification informing them that a participation has been made. The Participant’s email address is not transmitted to the Organizer.
Other information associated with the participation may be visible to the Organizer or to the public depending on the settings selected by the Participant.
7.3 Visibility of participation information
The Participant may separately choose the visibility of certain information associated with their participation, including:
- first name and the first letter of their last name;
- amount;
- message;
- photo.
Depending on the options available, this information may be visible:
- to anyone with the Money Pot link;
- only to the Organizer;
- to no one, where this option is offered.
The option allowing information to be hidden from the Organizer may in particular be offered for the first and last name. When the Participant chooses such an option, the relevant information is not displayed to the Organizer.
Information made public is visible to anyone with the direct link to the Money Pot.
7.4 Confirmation email and modification of the participation
After making a participation, the Participant receives a confirmation email containing a secure link allowing them to view and edit their participation, including the information visible publicly or visible to the Organizer.
This link is secured by a unique token and has no planned expiry date. The Participant is responsible for keeping this link confidential. Anyone with this link may access the corresponding editing area.
Article 8 – Withdrawals
The Organizer may manually request the withdrawal of available funds from their Money Pot to their bank account, subject to the following conditions:
- their identity has been verified by Stripe;
- valid bank details / IBAN in their name have been provided;
- the funds are available according to Stripe’s timelines;
- no suspension, dispute, fraud, legal obligation, Stripe request, or compliance measure blocks the withdrawal.
The minimum withdrawal amount is 1 euro.
Funds may become available within an indicative period of 2 to 7 business days, depending on the timelines applied by Stripe, the payment method used, security checks, and applicable availability rules.
The Organizer may make as many withdrawals as they wish, subject to compliance with the minimum amount and the conditions above. Withdrawals are manual: no automatic bank transfer is set up by default.
Memorable Day may block, delay, or refuse a withdrawal in the event of suspected fraud, misuse, dispute, ongoing refund, legal obligation, Stripe request, non-compliance of the Money Pot, or unsatisfied request for supporting documentation.
Article 9 – Voluntary Contribution and Business Model
At the launch of the service, Memorable does not charge any mandatory fees on Money Pots. The platform is mainly financed through a Voluntary Contribution offered to Users.
This Voluntary Contribution may be offered in particular at the time of a withdrawal, and at the time of a participation. It helps support the operation, hosting, development, support, security, payment costs, and general expenses of Memorable.
When it is offered at the time of withdrawal, the Organizer may freely choose:
- a percentage of the amount withdrawn, between 0% and 10%;
- or a custom amount where this option is offered.
The Organizer may choose 0%. The amount of the Voluntary Contribution is clearly displayed before validation. If the Organizer makes several withdrawals, they may choose a different Voluntary Contribution for each withdrawal.
When it is offered at the time of a participation, the Participant may freely choose to add a Voluntary Contribution to their payment, or to add none. Outside the study described below, no amount is pre-added to the basket or pre-selected: it is the Participant who chooses to add a Contribution. In all cases, the total to be paid is displayed before validation. This Contribution is added on top of the participation and does not reduce the amount paid to the Money Pot.
Study on how the Voluntary Contribution is presented. Memorable Day studies how the presentation of the Voluntary Contribution influences Participants’ choices. The study only covers Money Pots whose Organizer agreed to take part in it; the Organizer may end it at any time from the Money Pot’s settings. On these Money Pots, each Participant sees at random, with a one-in-two chance:
- either the suggested screen, where they choose themselves to pay with or without a Voluntary Contribution;
- or the prefilled screen, where a Voluntary Contribution is already included in the total to be paid. The Participant can change its amount or bring it down to €0 before paying, through the “Edit” link, and must tick a box confirming their Contribution to continue.
After payment, a Participant who saw the prefilled screen is told about the study and can get a full refund of their Voluntary Contribution in one click. This refund is free of charge and does not change the amount paid to the Money Pot.
Payback to participating Money Pots. Memorable Day does not keep the extra Voluntary Contribution to the platform brought in by the prefilled screen. At the end of the study, Memorable Day measures the share of participations left as Voluntary Contribution on the suggested screen and on the prefilled screen, and pays the difference back to each participating Money Pot, calculated on the participations made through the prefilled screen. Voluntary Contributions refunded to the Participant are not counted.
For example, if Voluntary Contributions to the platform amount to 1% of the participations made through the suggested screen and 3% of those made through the prefilled screen, the 2% difference is paid back to the participating Money Pots: for €100 of participations made through the prefilled screen, Participants paid, on top of that €100, €3 of Voluntary Contribution to the platform; Memorable Day keeps €1, what the suggested screen would have brought in, and pays €2 back to the Money Pot. These rates are an example; the actual rates are measured by the study and published on Memorable's blog.
The Voluntary Contribution is inclusive of all taxes (TTC). As Memorable Day is subject to VAT, an invoice may be issued for the amounts corresponding to this Voluntary Contribution.
Memorable Day reserves the right to change its business model, including by modifying the terms of the Voluntary Contribution or introducing other fees, provided that Users are informed under appropriate conditions and that fees are clearly visible before any relevant operation.
Article 10 – Refunds and Disputes
The Participant may request a refund by contacting Memorable Day at [email protected]. Refund requests are reviewed on a case-by-case basis, in particular depending on the situation of the Money Pot, the status of the funds, any withdrawals already made, Stripe rules, and the circumstances invoked.
Where a refund is accepted and technically possible, it may be made by Memorable Day through Stripe. Refund fees of 2% may be deducted from the amount refunded to the Participant in order to cover processing costs.
In the event of a bank dispute, chargeback, payment cancellation, fraud, or disputed transaction, Memorable Day may block withdrawals, suspend the Money Pot, request supporting documentation, or take any measure necessary to protect Users, Stripe, Memorable Day, and the relevant third parties.
Article 11 – Liability
The Organizer is solely responsible for:
- the creation, content, and purpose of their Money Pot;
- the truthfulness of the information published;
- sharing the Money Pot link;
- the use of the Donations received;
- any tax, social security, accounting, or administrative obligations;
- preserving the confidentiality of their access credentials and secure links.
Memorable Day does not guarantee the success of a Money Pot, the amount collected, the actual use of funds by the Organizer, the truthfulness of information published by the Organizer, or that the link will not be shared by third parties.
Donations are made without consideration. In the event of a disagreement regarding the use of funds, the Participant must, unless Memorable Day is at fault, contact the Organizer.
Memorable Day does not provide any tax, accounting, wealth management, or legal advice. Users are solely responsible for any obligations that may apply to Donations paid or received.
Article 12 – Suspension, Closure, and Compliance Measures
Memorable Day may suspend, close, or limit a Money Pot, block participations, block withdrawals, or refund participations where:
- the Money Pot appears fraudulent, unlawful, misleading, or contrary to these Terms;
- the Organizer does not provide the requested supporting documentation;
- Stripe requests or imposes a restriction measure;
- a legal, regulatory, judicial, or administrative obligation so requires;
- a dispute, refund, suspicion of fraud, or compliance risk is identified;
- the Money Pot infringes the rights of a third party, the image of Memorable Day, or the security of the service.
These measures may be taken without prior notice where urgency, security, compliance, or the protection of Users so justifies.
Article 13 – Personal Data
The terms under which Users’ personal data is processed are described in the Data Protection Policy available on the Site.
It is recalled that the Participant’s email address is not transmitted to the Organizer. Certain other participation information may be visible publicly or to the Organizer depending on the Participant’s choices.
Article 14 – Force Majeure
The Parties shall not be held liable for a delay or failure in the performance of their obligations where such delay or failure results from an event beyond their control, which could not reasonably have been foreseen and whose effects cannot be avoided by appropriate measures.
The following may in particular constitute force majeure events or similar events: major infrastructure failure, internet network interruption, prolonged unavailability of a payment provider, cyberattack, administrative decision, natural disaster, war, external strike, or any event recognized as such by French case law.
Article 15 – Applicable Law and Dispute Resolution
These Terms are governed by French law.
The Parties undertake to seek an amicable solution to any dispute relating to the interpretation or performance of these Terms. Failing amicable resolution, the dispute shall be submitted to the competent courts under ordinary law.
Article 16 – Miscellaneous Provisions
If any provision of these Terms is declared null, unenforceable, or deemed unwritten, the other provisions shall remain fully applicable.
Memorable Day’s failure to invoke a breach of any obligation under these Terms shall not be interpreted as a waiver of its right to invoke such breach at a later date.
These Terms are drafted in French. In the event of translation, only the French version shall prevail in the event of a dispute.
Article 17 – Contact
For any question relating to the Services, these Terms, a Money Pot, a participation, a withdrawal, a refund, or a report, the User may contact Memorable Day at: [email protected].
